A DRIVER clocked speeding has avoided a ban to protect his job and home.

Adrian Tottey, of Oakleigh, Knutsford, was sentenced when he appeared at Chester Magistrates’ Court on September 23.

The 40-year-old had pleaded guilty to exceeding the 30mph speed limit at an earlier hearing on August 8.

Tottey was caught speeding while driving an Audi on Chelford Road at Higher Town Green at 5.54pm on April 11, this year.

A Home Office approved speed camera recorded his speed at 37mph, the court heard.

The 30mph speed limit was signified by street lighting placed at less than 200 yard intervals Magistrates decided not to impose a ‘totting’ disqualification after listening to mitigating circumstances.

Without a driving licence, Tottey said he would become unemployed as he would be unable to run a business.

He would lose the home where he lives with his family, he told the court, as he would be unable to maintain mortgage payments.

The defendant was fined £300 and ordered to pay £120 victim surcharge and £110 costs.

His driving licence was endorsed with three points.

Magistrates took him guilty plea into account when imposing the sentence.

Tottey was given until November 18 to pay the £530 court penalty.
